The Board is providing the following clarification regarding basketball goals under Article X, Section 25 of the Latham Park Declaration.
The Declaration permits temporary basketball goals that are “used on driveways” and requires them to be stored in a garage or other permitted structure “when not in use.”
Based on guidance from the Association’s legal counsel, the Board interprets “in use” to mean a basketball goal that is regularly used for its intended purpose, functional, and maintained in good condition. A goal that is broken, substantially deteriorated, or otherwise not functional is considered not in use and must be stored in accordance with Section 25.
As part of this clarification, any basketball-goal violations issued during the past two months will be marked as closed. Going forward, enforcement will be based on the interpretation outlined above.
This clarification is intended to consistently enforce the existing language of the Declaration and does not create a new restriction.
