In accordance with Article IV – Common Property, of the Latham Park Homeowners Association (LPHOA) Declaration of Covenants, Conditions, Easements and Restrictions for Latham Park, these Rules and Regulations shall be implemented and maintained by the LPHOA Facilities and Grounds Committee, with the approval of the LPHOA Board of Directors. The pool, pool deck, and pavilion [POOL AREA] is maintained for the benefit of all LPHOA residents and their guests. The rules and regulations are designed to maintain safety, and respect for all individuals using these areas. The Facilities and Grounds Committee maintains the right to restrict the access of LPHOA residents for non-adherence to the rules and regulations pursuant to Florida Statutes Section 720.305(2). Any requests for changes should be submitted via email directly to the Facilities and Grounds Committee. These rules do not cover LPHOA sponsored events/gatherings.

General Pool Rules
  • All LPHOA residents are responsible for abiding by the pool rules and for apprising their guests of the rules.
  • Swimming is at each individual’s own risk and responsibility. No lifeguard is present at the pool. Persons who cannot competently swim must be accompanied by an adult (18 and over) responsible for their safety.
  • Diving or running is not permitted.
  • Ball playing is not permitted on the pool deck.
  • Unruly behavior such as wrestling and excessive noise-making is prohibited.
  • No bikes, scooters, skateboards or skates may be used on the pool deck or in the fenced in pool area.
  • Water guns, super soakers and similar-type toys are not permitted.
  • Strollers must be kept a safe distance from the pool.
  • Items may not be placed in a way that obstructs free passage to the pool.
  • Glass of any kind is prohibited in the pool area. Beverages must be contained in cans, plastic or paper.
  • Liquor or alcoholic beverages are prohibited.
  • Food and beverages are prohibited in the pool and on the pool deck. All food and beverages must be consumed in the pavilion section of the pool area.
  • No portable grills of any kind are permitted.
  • Animals are not permitted in the pool area.
  • Loud music is not permitted.
  • LPHOA furniture must be used appropriately by individuals. If furniture is moved, it must not restrict access to
    any area and must be placed back in its original location.
  • Personal chairs and lounges are permitted. They must not obstruct access to the pool.
  • Guests are limited to (6) per residence, in the pool area. All guests must be accompanied by a LPHOA homeowner or resident. Gatherings with more than ten (10) individuals are considered a party/gathering and LPHOA owners/residents are required to request the use of space and abide by the Rules and Regulations set forth in the Party/Gatherings section.
  • Noodles, floaties, swim boards and small tubes are allowable.
  • Large floats (ex. flamingo, swan) including large tubes that obstruct a view of the bottom of the pool are not
    permitted. Individuals are responsible to remove the floats, noodles etc. when not in use. These items must not restrict the use of the pool to other LPHOA residents.
  • Large blow ups such as bouncy houses, slides, play equipment, etc. are not permitted in the pool area or surrounding common areas.
  • Gas fireplace must be operated by a responsible adult (18 and over). All instructions as posted must be adhered to.
  • Gates must be opened using authorized key fobs only. Gates are not permitted to be left open or propped open.
  • Security cameras are in place for the safety of all individuals. They are maintained by LPHOA.
  • WiFi is available in the pool area.
  • No smoking in the pool area.
  • The pool is open for use from dawn to dusk.
  • All trash must be disposed of properly.
  • Overnight parking at the pool parking lot is prohibited. Violators will be towed at the owners expense, unless authorized by the Board of Directors. To obtain permission, contact Melrose.

LPHOA residents are entitled to request pool area for personal party/gatherings/events by submitting a completed Pool Area Reservation Form.  Please be sure to review the terms and conditions in the Latham Park Pavilion Reservation and Pool Area Use Agreement. While parties/gatherings are permitted, please be advised that the pool area remains open for all LPHOA resident’s usage. Please be respectful of all members while having your party/gathering.

  • A party/gathering shall occur when there are ten (10) or more individuals. The LPHOA Resident or Owner hosting the event must be present at the party/gathering.
  • Maximum number of guests allowed are thirty (30) persons, not including the LPHOA resident or owner hosting the event.
  • All parties/gatherings can be requested four months in advance and must be requested by completing the “Latham Park Pool and Pavilion Common Area Reservation and Use Agreement. The request must include the date, time and number of individuals attending. Requests will be approved on a first come first serve basis. A $150 refundable security deposit is required at the time of request.
  • The Facilities and Grounds Committee is responsible for maintaining a calendar of all parties/gatherings, that will be available for all LPHOA residents to view.
  • Only one party/gathering is permitted per day.
  • No parties/gatherings are permitted without the consent of the Facilities and Grounds Committee.
  • LPHOA resident or owner hosting the party/gathering is responsible for adhering to and apprising their guest of the LPHOA pool rules and regulations.
  • Reminder – No large inflatables (such as bouncy houses, slides etc.) are permitted in fenced pool area or outside common area.
  • The party/gathering is allowed the use of five (5) lounge chairs, and one side of the pavilion area, including one dining table and its chairs.
  • The LPHOA Resident or Owner Host is responsible for the removal of all trash pertaining to their party/gathering. No trash removal services are available at this time to accommodate parties/gatherings.
  • The LPHOA resident or owner host is responsible for ensuring that all furniture is put back in its original place and condition.
  • The Facilities and Grounds Committee maintains the right to refuse access for future parties/gatherings if the LPHOA pool and common area rules and regulations are not adhered to.
  • Parking Lot and adjoining parking spaces next to the pool area are reserved for personal vehicles only.

To discourage violations which may result in county fines and/or suspension of our pool license, a tiered penalty system has been implemented for severe infractions of the pool rules and/or swimming after hours.

1st time: Warning letter issued by Don Asher
2nd time: 15-day suspension from pool use
3rd time: 30-day suspension from pool use
4th (or more): 1-year suspension from pool use

All violations and penalties are cumulative.  In addition, if a resident is reported to be at the pool while under suspension or after hours, the Orange County Sheriff’s Office may be called, and you may be charged with trespassing.

Ponds

  • No fishing
  • No trapping
  • No swimming
  • No wading
Beware of alligators, snakes and other dangerous wildlife that may be present in this area.

The Pavilion reservation and POOL AREA use is reserved exclusively for residents of Latham Park.
The Resident reserving the Pavilion must be present at all times during the event.
The Resident reserving the Pavilion will be responsible for any damage caused by the resident or the resident’s guests and invitees.
A refundable Security Deposit in the amount of $150.00, made payable to Latham Park , must be submitted with this Agreement to Don Asher Management - 16 W Dakin Avenue, Kissimmee FL 34741
Please collect all trash and take it with you at the conclusion of your event -- failure to do so may result in loss of your deposit!
